As soon as you avail of services in one of our pharmacies or facilities (hospital, retirement home or similar) as a patient or for the purpose of medical care, we save any personal data required for your healthcare provision. Apart from your address, this also includes details on your health insurance or similar details required in order to fulfil our contractual obligations.

The legal basis for such data processing is either Art. 6, para. 1 b) GDPR, if processing is on the basis of a contract with you, or Art. 6, para. 1 f) GDPR, as we require this data for your healthcare provision and therefore have a justified interest in processing thereof.

Special personal data such as health data, for example, may also be processed if it is required in accordance with Art. 9, para. 2 h) for the purpose of healthcare, provision or treatment in the area of healthcare and social services.

In accordance with Art. 9, para. 3 GDPR, however, your health data is only processed by specialist personnel or under their responsibility. This specialist personnel and any persons working under their responsibility are covered by the obligation of professional secrecy and duty of confidentiality in accordance with the statutory provisions of the German Drugs Act and/or the Pharmacy Practice Order, as well as our own in-house regulations.

In all other cases, we only save your personal data if you provide express written consent.

  • in accordance with Art. 16 GDPR, to request without delay the revision of incorrect personal information or the completion of personal data stored by us;
  • in accordance with Art. 17 GDPR, to request the deletion of your personal data stored by us insofar as processing is required for exercising the right to freedom of expression and information, for fulfilling a legal obligation, for reasons relating to public interest or for asserting, exercising or defending legal claims;
  • in accordance with Art. 18 GDPR, to request the restriction of processing of your personal data insofar as the correctness of data is disputed by you, processing is unlawful but you reject deletion thereof and we no longer require the data but you require it for asserting, exercising or defending legal claims, or you have filed an objection to processing in accordance with Art. 21 GDPR;
  • in accordance with Art. 20 GDPR, to receive your personal data provided by you in a structured, conventional and machine-readable format, or to request transmission thereof to another responsible person;
  • in accordance with Art. 7, para. 3 GDPR, to revoke your consent provided once at any time. This means that we will no longer be authorised to continue data processing in the future which was based on this consent and
  • to file a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a general rule, you can contact the supervisory authority for your usual place of residence or workplace or our place of business.

7. Right of objection

If your personal data is processed on the basis of justified interests in accordance with Art. 6, para. 1, sentence 1 f) GDPR, you are entitled to file an objection in accordance with Art. 21 GDPR to processing of your personal data insofar as reasons prevail arising from your particular situation or the objection is directed against direct marketing. In the latter case, you have a general right of objection which is implemented by us without necessitating the indication of a particular situation.
